Welcome to MyCareNetwork, a comprehensive healthcare network platform designed to connect families, healthcare providers, and medical facilities. These Terms of Service ("Terms") govern your access to and use of the MyCareNetwork website, mobile applications, and related services (collectively, the "Platform").
By creating an account, accessing our Platform, or using any of our services, you agree to comply with and be legally bound by these Terms, whether or not you become a registered user. If you do not agree to these Terms, you must not access or use the Platform.
Acceptance of Terms and User Eligibility
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Push Resources, Inc. d/b/a My Care Network ("Company," "we," "us," or "our"), governing your access to and use of the My Care Network mobile application, website, and all related services (collectively, the "Platform"). The Platform is a care navigation tool that helps individuals and families find and connect with healthcare, therapy, and home- and community-based service providers. We are not a healthcare provider.
1.1 Age Requirement
The Platform is intended for use by individuals who are 18 years of age or older. By creating an account or using the Platform, you represent and warrant that you are at least 18 years of age. If you are using the Platform on behalf of a minor in your care, you represent that you are the parent or legal guardian of that minor and that you accept these Terms on their behalf.
1.2 Legal Capacity
You represent and warrant that you have the legal capacity to enter into these Terms, that you are not barred from using the Platform under applicable law, and that all information you provide is accurate, current, and complete.
1.3 Provider Users
If you register as a healthcare, therapy, or community-based service provider ("Provider"), you additionally represent and warrant that:
- You are duly licensed, credentialed, and authorized to provide the services you list on the Platform;
- All information submitted regarding your credentials, licensure, availability, and service offerings is accurate and up to date;
- You will promptly update your information to reflect any changes in licensure, availability, or service scope;
- You have authority to bind the organization on whose behalf you register.

PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE USING THE MY CARE NETWORK PLATFORM. BY ACCESSING OR USING THE PLATFORM, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT USE THE PLATFORM.
User Accounts
2.1 Account Registration
To access certain features of the Platform, you must create an account. You agree to provide accurate, complete, and current registration information and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials.
2.2 Account Security
You are solely responsible for all activities that occur under your account. You agree to notify us immediately at info@mycarenetwork.com if you suspect any unauthorized access to or use of your account. We are not liable for any loss or damage arising from your failure to safeguard your account credentials.
2.3 Account Suspension and Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms, provided false information, or engaged in conduct harmful to other users, providers, or the integrity of the Platform. You may also delete your account at any time through the Platform settings.

- • Log out after using shared devices
Account Deletion
You may delete your account at any time through account settings. Upon deletion, certain information may be retained as required by law or for legitimate business purposes.
Platform Description and Healthcare Disclaimer
3.2 No Provider Endorsement or Relationship
The inclusion of a provider on the Platform does not constitute our endorsement, recommendation, or guarantee of that provider's services, quality, or suitability. We do not employ, supervise, or control any providers listed on the Platform. Any care or service relationship is solely between you and the provider you choose to engage.
3.3 Emergency Services
THE PLATFORM IS NOT INTENDED FOR MEDICAL EMERGENCIES. If you or someone in your care is experiencing a medical emergency, call 911 or go to the nearest emergency room immediately.
3.4 Provider Verification
While we make reasonable efforts to verify provider credentials and listings, we cannot guarantee the accuracy, completeness, or currency of any provider information. You are encouraged to independently verify the credentials and suitability of any provider before engaging their services.
Privacy, Data Use, and HIPAA Compliance
4.1 Privacy Policy
Your use of the Platform is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.
4.2 Data Collection and Use
We collect the following personal information, depending on how you use the Platform:
- Account Creation: email address and phone number, used to create and authenticate your account
- User Profiles (optional): if you create a personal profile to be placed on provider waitlists, we collect your name, date of birth, gender, and contact information. This profile information is collected solely to enable providers to add you to their waitlists and is shared with providers only at your direction
- Provider Accounts: business contact information, credentials, and billing details necessary to maintain your subscription and listing
We implement reasonable administrative, technical, and physical safeguards to protect all information we collect.
4.3 HIPAA Compliance
My Care Network is committed to compliance with applicable federal and state health privacy laws, including the Health Insurance Portability and Accountability Act of 1996 ("HIPAA") and the Health Information Technology for Economic and Clinical Health Act ("HITECH") to the extent they apply to our operations.
- My Care Network may function as a Business Associate to covered healthcare entities. Where required, we will enter into a Business Associate Agreement ("BAA") as required by HIPAA.
- If you are a covered entity or business associate using the Platform, you are responsible for your own HIPAA compliance obligations with respect to protected health information ("PHI") you manage.
- The Platform is not designed or intended to store PHI as defined under HIPAA except to the extent expressly set forth in a separately executed BAA.
- We do not sell, rent, or disclose PHI to third parties except as permitted by applicable law and our Privacy Policy.
4.4 Minnesota Health Records Act
We comply with applicable Minnesota data privacy laws, including the Minnesota Health Records Act (Minn. Stat. § 144.291 et seq.). Minnesota residents have rights regarding their health records and personal data as described in our Privacy Policy.

Payments, Subscriptions, and Refunds
5.1 Platform Access
The Platform is free for individuals and families seeking care. There are no fees to create an account, build a profile, or search for and connect with providers. Provider organizations pay a subscription fee to list their services, manage their profiles, and connect with individuals and families on the Platform. All Provider subscription pricing, tiers, and features are described on the Platform and are subject to change with reasonable prior notice to active subscribers.
5.2 Provider Subscriptions
Providers who elect to list their services on the Platform may be subject to subscription fees. By subscribing, you authorize us to charge the applicable fees to your designated payment method on the billing cycle selected at enrollment (monthly or annually). Subscription fees are billed in advance.
5.3 Billing and Payment
All fees are stated in U.S. dollars. You authorize us to charge your payment method for all fees incurred. If a payment fails, we may suspend your access until payment is resolved. You are responsible for providing accurate and current billing information and for keeping that information updated.
5.4 Cancellation
You may cancel your subscription at any time through your account settings or by contacting us at legal@mycarenetwork.com. Cancellation takes effect at the end of the then-current billing period. Cancellation does not entitle you to a refund for any previously billed period, except as described in Section 5.5.
5.5 Refund Policy
Refunds are generally not provided for partially used subscription periods. However, we will issue a full refund if:
- You request a refund within 7 days of your initial subscription purchase and have not materially used the paid features; or
- We are unable to deliver the core Platform services due to a fault on our part for which we are solely responsible.
Refund requests must be submitted to info@mycarenetwork.com. Approved refunds will be processed within 10 business days to the original payment method. We reserve the right to decline refund requests that appear to abuse this policy.
5.6 Taxes
You are responsible for all applicable taxes, levies, or duties imposed by any taxing authority in connection with your use of the Platform, excluding taxes on our net income.
5.7 Price Changes
We reserve the right to modify subscription pricing at any time. We will provide at least 30 days' advance written notice to active subscribers before any price increase takes effect. Continued use of the Platform after a price change constitutes your acceptance of the new pricing.
Intellectual Property
6.1 Ownership
All content, features, and functionality on the Platform — including but not limited to software, code, design, text, graphics, logos, icons, images, data compilations, and the "My Care Network" name and brand — are the exclusive property of Push Resources, Inc. d/b/a My Care Network or its licensors and are protected by United States and international copyright, trademark, trade secret, and other intellectual property laws.
6.2 Limited License to Users
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for your personal, non-commercial care navigation purposes (for individuals and families) or for your authorized provider listing purposes (for providers), in accordance with these Terms.
6.3 Restrictions
Without our prior written consent, you may not:
- Copy, reproduce, distribute, publicly display, or create derivative works based on Platform content
- Reverse engineer, decompile, or attempt to extract source code from the Platform
- Use automated means such as scrapers, bots, or crawlers to access, collect, or index Platform data
- Use Platform content for any commercial purpose outside your authorized use
- Remove or alter any copyright, trademark, or other proprietary notices
6.4 User-Submitted Content
By submitting content to the Platform (including provider profiles, reviews, or other information), you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such content in connection with operating and improving the Platform. You represent that you own or have all rights necessary to grant this license and that your content does not infringe any third-party rights.
6.5 Feedback
If you submit feedback, suggestions, or ideas about the Platform, you agree that we may use such feedback freely without restriction or compensation to you.
Protecting Our Intellectual Property
My Care Network's intellectual property is valuable and protected. Any unauthorized use may result in legal action.
Prohibited Conduct
You agree not to use the Platform to engage in any of the following prohibited activities:

Violate any applicable federal, state, or local law or regulation
False Information
Submit false, misleading, or fraudulent provider or user information
Impersonation
Impersonate any person or entity or misrepresent your affiliation
Harassment
Harass, threaten, defame, or harm any user, provider, or Company personnel
Spam
Transmit spam, unsolicited messages, or malicious code or software
Unauthorized Access
Attempt to gain unauthorized access to any part of the Platform or related systems
System Interference
Interfere with or disrupt the integrity or performance of the Platform
Data Harvesting
Collect or harvest personal information of other users without consent
Violation Consequences
Violation of these prohibitions may result in immediate termination of your account, legal action, and notification to appropriate law enforcement authorities. We reserve the right to investigate and take appropriate action against anyone who violates these Terms.
Third-Party Links and Services
The Platform may contain links to third-party websites, applications, or services. These links are provided for convenience only and do not constitute our endorsement of or responsibility for such third-party content or services. Your use of third-party services is governed by their own terms and privacy policies. We are not responsible for any loss or damage arising from your use of third-party services.
Important Note
When you leave our Platform, we are no longer responsible for the content, privacy practices, or security of external websites. Always review the terms and privacy policies of third-party services before providing any personal information.

Disclaimers of Warranties
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MY CARE NETWORK EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
No Guarantee of Uninterrupted Service
We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
No Guarantee of Accuracy
We do not warrant the accuracy, completeness, or reliability of any provider information listed on the Platform.
Your Responsibility
You acknowledge that your use of the Platform is at your sole risk. You are solely responsible for verifying any information obtained from the Platform and for any decisions or actions taken based on such information.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MY CARE NETWORK, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Total Aggregate Liability Cap
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF:
The total fees you paid to us in the 12 months preceding the claim
One Hundred U.S. Dollars ($100.00)
Jurisdictional Limitations
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you to the extent prohibited by applicable law. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
Indemnification
You agree to defend, indemnify, and hold harmless Push Resources, Inc. d/b/a My Care Network and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:
Your Use of the Platform
Any activity or action taken under your account
Violation of These Terms
Any breach of your obligations under this agreement
Violation of Applicable Law
Any violation of local, state, federal, or international law
Content You Submit
Any content, information, or materials you post on the Platform
Interaction with Providers
Your interaction with any provider found through the Platform
Indemnification Process
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with us in asserting any available defenses.
Governing Law and Dispute Resolution
12.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law principles.
12.2 Informal Resolution
Before filing any formal legal proceeding, you agree to contact us at legal@mycarenetwork.com and attempt to resolve any dispute informally for a period of at least 30 days from the date of written notice.
12.3 Jurisdiction and Venue
If a dispute cannot be resolved informally, you agree that any legal action or proceeding arising out of or related to these Terms or the Platform shall be brought exclusively in the state or federal courts located in Hennepin County, Minnesota. You consent to the personal jurisdiction of such courts and waive any objection to venue.
12.4 Waiver of Class Action
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU WAIVE YOUR RIGHT TO PARTICIPATE IN ANY CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST MY CARE NETWORK.

Modifications to These Terms
We reserve the right to update or modify these Terms at any time. We will notify registered users of material changes by email or by posting a prominent notice on the Platform at least 14 days before the changes take effect. Your continued use of the Platform after the effective date of any change constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform and may cancel your account.

Important: It is your responsibility to review these Terms periodically. The "Last Updated" date at the top of these Terms indicates when the most recent changes were made. Your continued use of the Platform after any modifications constitutes your acceptance of the updated Terms.
General Provisions
14.1 Entire Agreement
These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and My Care Network with respect to the Platform and supersede all prior agreements and understandings.
14.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it enforceable.
14.3 Waiver
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of My Care Network.
14.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms and our rights hereunder freely, including in connection with a merger, acquisition, or sale of assets.
14.5 No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights. Only you and My Care Network have rights under these Terms.
14.6 Force Majeure
We will not be liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including acts of God, natural disasters, pandemic, government action, or telecommunications failures.
